Registration: Registration between June 27 - July 11 is not required to enter the challenge and does not influence the results, but it is highly recommended to enter the special promotion.
Custom Avatar Usage: Your video must primarily feature your custom Dream Avatar or Instant Custom Avatar.
Video Topic & Length: The video topic can be on anything you’d like, as long as it adheres to the challenge’s Terms & Conditions. There is no minimum or maximum video length.
External Editing: You can use external editing software. Editing outside of AI Studios is allowed as long as you use Dream Avatar and/or Instant Custom Avatar. Your project file link may be required for confirmation.
Submission and Social Media Posting: Videos must be submitted through the submission link and posted on social media to qualify for the challenge.
Multiple Entries: Although multiple video entries can be submitted, each video must be unique and not simply the same video posted on different platforms.
Terms for the Creator Challenge (“Contest”) are contained below:
Agreement to Terms: By submitting an Entry to the Contest, the entrant (“You”) agrees to be fully unconditionally bound by these Terms. You also represent and warrant that You meet the eligibility requirements and that the Contest and You entering the Contest is not prohibited in Your jurisdiction. In addition, You agree to accept the decisions of DeepBrain AI as final and binding as it relates to the Contest.
Eligibility: This Contest is open only to persons who are 18 years old or older as of the date of Entry. Employees of DeepBrain AI, Inc. (“DeepBrain AI”), its subsidiaries, advertising and promotion agencies, and suppliers, (together, “Employees”), and immediate family members and/or those living in the same household of Employees are not eligible to participate in the Contest. This Contest is not open to any individual in a jurisdiction where the Contest or the individual entering the Contest would be prohibited by law. The Contest is free to enter, and no purchase is necessary to participate. However, please be aware that while participation in the Contest is open to all, accessing the complete range of resources may require a paid subscription to AI Studios. This is not a condition for entry but could enhance your experience and capabilities within the contest.
Registration Period: During the registration period between June 27, 2024, 12:00 AM PST, and July 11, 2024, 11:59 PM PST, if you submit a registration form, you may be eligible to receive our 1-month Personal plan with 15 minutes of free credit for use in AI Studios. Please note that not everyone will receive this offer; recipients are selected randomly. (a) This offer is not a giveaway or sweepstakes; it is a promotional offer contingent upon completing and submitting the registration form. (b) Recipients of the promotional offer are randomly selected. (c) Recipients will be notified via email before the start of the challenge's official submission period, as listed on the Contest page. (d) If you do not receive a confirmation within this period, you have not been selected. (e) Incomplete or inaccurate forms may lead to disqualification at DeepBrain AI's sole discretion. (f) The awarded credits should be used in good faith as part of your participation in the AI Avatar Challenge and are subject to the same usage terms and conditions as other AI Studios credits. (g) DeepBrain AI reserves the right to modify or terminate this promotional offer at any time without prior notice. (h) By participating, you acknowledge that DeepBrain AI is not liable for technical issues, submission errors, or other circumstances that may prevent your form or credits from being received or processed. (i) All decisions by DeepBrain AI regarding this offer are final and binding. (j) Registration is not required to participate in the Contest, but it is necessary to be eligible for the promotional offer. (k) Promotional recipients will receive our 1-month Personal plan with 15 minutes of free credit. If you are a free user, your plan will be upgraded to the Personal plan. If you already have our Personal or Team Plan, you will gain 15 additional minutes in your account.
Contest Period: Entries for each Contest will be open for two weeks from July 12, 2024, 12:00 AM to July 28, 2024, 11:59 PM. Entries must be received before the end of the Contest Period as listed on the Contest page.
How to Enter: (a) To participate in the Contest, you must create a video using DeepBrain AI that adheres to the Competition Guidelines and share it on your social media channel. (b) Multiple entries are allowed. (c) Entries that contain sexual content, violence or gore, or promote discrimination against any individual or group or that otherwise contain content that in the view of DeepBrain AI is inappropriate, will not be accepted. (d) The Entry must fulfill all Contest requirements, as specified in the Challenge Guideline, to be eligible to win a prize. (e) Entries that are incomplete, do not adhere to the Terms, or do not comply with DeepBrain AI’s Content Terms of Use agreement (available here https://www.deepbrain.io/terms-of-use) may be disqualified at the sole discretion of DeepBrain AI. (f) If You use fraudulent methods or otherwise attempt to circumvent these Terms, your submission may be removed from eligibility at the sole discretion of DeepBrain AI.es:
Prizes: (a) Up to a maximum of fifty-one (51) winners will be selected based on the total number of votes received from the public voting system (refer to “Winners Selection and Notification”).(b) The prize pool totals $10,000 USD, distributed as follows: (i) The first-place winner, as determined by the winner selection process, will receive $5,000 USD. (ii) The remaining fifty (50) winners will each receive $100 USD.(c) The prizes will be distributed to the Winners shortly after the contest period ends.(d) All specifics of the prizes shall be solely determined by DeepBrain AI. Prizes are as stated, they are not transferable and there are no alternative prizes or cash substitutes. If for any reason there are logistical or other issues with providing a prize, DeepBrain AI may at its sole discretion provide a substitute prize of equivalent value.(e) Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, and any fees incurred during the transfer process, such as current exchange fees, shall be the sole responsibility of the winner.
Winners Selection and Notification: (a) Winners will be determined by the number of votes they receive on the dedicated voting page (refer to “Voter Terms & Conditions”). (b) Certain entrants may be asked to provide their original design files for verification purposes. (c) The Winners will be notified via a private message, and/or comment on their Entry and announced via email or on the DeepBrain AI Challenge page within five (5) days following the selection of the winners. (d) To the extent permitted by law, DeepBrain AI shall have no liability for: (i) any Winner’s failure to receive notices due to spam, junk e-mail or other security settings or for Winner’s provision of incorrect or otherwise non-functioning contact information; (ii) any Winner’s inability to receive or participate in any component of the prize. (e) If a Winner cannot be contacted, is ineligible, fails to claim the prize within forty-eight (48) hours from the time notification was sent, or fails to provide any other information or documentation (if required), the prize may be forfeited and an alternate Winner selected. Receipt by Winner of the prize offered in this Contest is conditioned upon compliance with any and all federal, state, and local laws and regulations. (f) ANY VIOLATION OF THESE OFFICIAL TERMS BY WINNER, AT DEEPBRAIN AI’S SOLE DISCRETION, WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE CONTEST, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
By submitting an Entry, You:(a) understand and consent to DeepBrain AI, anyone acting on behalf of DeepBrain AI, and DeepBrain AI’s licensees, successors, and assigns, having the right, where permitted by law, to print, publish, broadcast, distribute, and use (including in an excerpted or slightly modified form) in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your Entry, first name, and statements about the Contest, for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent. (b) represent and warrant that your Entry is an original work of authorship by You, and does not violate any third party’s proprietary or intellectual property rights. If your Entry infringes upon the intellectual property right of another, You will be disqualified at the sole discretion of DeepBrain AI. If the content of your Entry is claimed to constitute an infringement of any proprietary or intellectual proprietary rights of any third party, You shall, at your sole expense, defend or settle against such claims. You shall indemnify, defend, and hold harmless DeepBrain AI from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which DeepBrain AI may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right. (c) Acceptance of Prize constitutes permission for DeepBrain AI to use the Winners’ name, likeness, and Entry for purposes of advertising and trade without further compensation. (d) acknowledge that you will not be reimbursed for any resources you purchased for this challenge.
DeepBrain AI Rights: DeepBrain AI reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Contest in the event DeepBrain AI becomes aware or reasonably suspects there to be virus, bug, non-authorized human intervention, fraud, or other cause beyond DeepBrain AI’s control corrupt that could affect the administration, security, fairness, or proper conduct of the Contest. In such a case, DeepBrain AI may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by DeepBrain AI. DeepBrain AI reserves the right to disqualify any Entry or Winner that, in its absolute discretion, could bring DeepBrain AI into disrepute. DeepBrain AI reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Contest or website or violates these Terms. DeepBrain AI has the right, in its sole discretion, to maintain the integrity of the Contest, to reasonably void entries, including, but not limited to: the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Contest may be a violation of criminal and civil laws. Should such an attempt be made, DeepBrain AI reserves the right to seek damages to the fullest extent permitted by law. By participating in this Contest, You acknowledge that:(a) by accepting the Prize you are not, and will not, be violating any laws, rules, or regulations applicable to you, including any rules related to your employment; and(b) in the event DeepBrain AI reasonably determines, in its sole discretion, that fulfilling your Prize would violate any law or regulation that is applicable to you, the Prize or DeepBrain AI, your Prize will be void and your entry disqualified.
Liability: By submitting an Entry, to the extent permitted by law, You agree to release and hold harmless DeepBrain AI and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether or not caused by negligence, from: (i) Your participation in the Contest and/or Your acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Contest; (v) electronic or human error in the administration of the Contest or the processing of entries. To the fullest extent permitted by law, Promoter is not liable where an entrant has breached local laws and/or regulations in connection with this Competition. You may have certain non-excludable rights or remedies under law. These Terms are subject to any non-excludable right or remedy You have under law.
Privacy Policy: DeepBrain AI collects information from You (such as your name, email address, social media handle and caption, your Entry and any other details you provide in entering the Contest) in order to conduct the Contest and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, and prize suppliers. Entry to the Contest is conditional on providing this information and by entering you acknowledge that your information will be held, used and shared by the DeepBrain AI to administer this Competition. This section should be read in conjunction with DeepBrain AI’s Privacy Policy (available at https://www.deepbrain.io/privacy-policy) which explains how DeepBrain AI collects, stores, and uses personal information which also sets out your data protection rights, including access and correction and how you may complain or raise a query about our handling of your information. Depending on Your location, Your information may be disclosed by DeepBrain AI outside your jurisdiction as contemplated in these Terms. Please see DeepBrain AI’s Privacy Policy for further details. Voting Process: Voters will cast their votes on a dedicated voting server, available at [https://https://www.deepbrain.io/challenge-vote]. Voters can vote on as many videos as they wish, with a limit of one vote per video, determined by IP address.
Voting Integrity: Voters are expected to vote in good faith and to judge each entry on its merit based on creativity, visual aesthetic, and adherence to the challenge. Any attempt to manipulate or unfairly influence the voting process is strictly prohibited. This includes but is not limited to the use of bots, macros, scripts, or other technical means to cast votes.
Disqualification: DeepBrain AI reserves the right to disqualify any votes that it believes, in its sole discretion, are not cast in accordance with these Terms and Conditions or are found to be fraudulent or tampered with in any way. Any voter found to be in violation of these terms may be banned from future participation in DeepBrain AI contests and promotions.
Privacy: By voting, you agree that DeepBrain AI may collect and use your voting data for the purpose of administering the contest and ensuring the integrity of the voting process. DeepBrain AI will handle all personal information in accordance with its Privacy Policy, available at https://www.deepbrain.io/privacy-policy.
General Conditions: DeepBrain AI reserves the right to cancel, terminate, modify, or suspend the voting process in the event of any technical failure, unauthorized intervention, fraud, or any other reason beyond its control. By participating in the voting process, you agree to be bound by these Terms and Conditions and the decisions of DeepBrain AI, which are final and binding in all matters related to the voting process.
Liability: To the fullest extent permitted by law, DeepBrain AI is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any vote to be received by DeepBrain AI on account of technical problems
